PLEASE READ THIS SUBSCRIPTION & REFUND POLICY CAREFULLY.

These Subscription & Refund Policy describe the terms and conditions applicable to your payment for Risemee Services and possible refund options, that are provided by Company (hereinafter collectively “Service(s)”) made available through or in connection with the App.

SUBSCRIPTION AND BILLING PROCEDURE

“Subscription” means a subscription to any fee-based portions of the Risemee Services, as deemed by Risemee at its sole discretion.

Risemee Services are offered under a Subscription. You agree to pay whatever fees and other charges are presented to you when you subscribe to a Subscription.

Certain Risemee Services may be offered for free under the terms specified on the (hereinafter - the “Site”, “Website”) and Risemee app (hereinafter - the “App”). The Website and App hereinafter are collectively referred to as a “Risemee”, “Platform”. If you used only free Services, you in any case agree to be bound by the Terms of Use.

To subscribe to the Risemee for the paid Services, you should place the order after an account registration.

While placing the order, you should complete the payment Information.

The price for the Subscriptions and their types are available on the Website/App.

You can make a purchase of Subscription for Services directly from the Apple App Store/Google Play Market or from the Site. The cost of a subscription depends on the type of subscription. You can find the current tariffs on the Site/App.

[if applicable] During the first 24 hours after registration, You may be (if applicable) entitled to test Risemee in accordance with provisions which is specified on the Site ("Trial"). We reserve the right to modify or terminate Trial offers at any time and for any reason. At the end of these 24 hours, subject to termination within this period, a subscription is automatically taken out on a periodical basis for an amount, which is specified on the Site. Subject to termination, this subscription is automatically renewed from subscription period to next subscription period and the card used is automatically debited.

Subscription automatically renews unless auto-renewal is turned off at least 24-hours before the end of the current subscription period. We can charge you for the future subscription period, if you didn’t turn off automatic renewal through your account (if applicable) or with assistance of our support team via [email protected]. In case you didn’t turn off automatic renewal, you will be charged for the next subscription period. You can cancel a subscription through your account (if applicable) or with assistance of our support team via e-mail [email protected]. You understand and confirm that if you forget to disable auto-renewal for new subscription period, it will not be a reason for a refund.

More details in relation to the refund conditions are available in our Refund Policy below, which we recommend reviewing before you start using Risemee Services.

All accounts are set up on a prepaid basis. We must receive payment before any billable product or service is provided and/or activated. You are required to keep valid credit/debit cards on file to charge for any recurring periodical based subscription fees and one-time or multi-pay fees. You are responsible for keeping all credit/debit card details and contact information current while using the Risemee.

Your subscription is NOT based on how much you use (or do not use) the Service. After payment execution for a subscription, you will receive a payment notification from us. All your receipts are available by request.

At its sole discretion, Company may modify or discontinue the Services, or may modify, suspend, or terminate Your access to the Services, for any reason, with or without notice to You and without liability to You or any third party. Company will not be responsible for refunding or otherwise paying any funds, amounts or credits that may be owed to You if we have suspended or terminated Your permission to use the Services. In addition to suspending or terminating Your access to the Services, Company reserves the right to take appropriate legal action, including without limitation pursuing civil, criminal or injunctive redress. Even after Your right to use the Services is terminated, this Agreement will remain enforceable against You and unpaid amounts You owe to Company for any purchases will remain due.

It is imperative that you comply with the Terms of Use, refraining from using the Services in any unlawful manner. You may not seek to reverse engineer the Risemee feature, use the Risemee to attempt to build a competitive product or service, or otherwise infringe our rights. You will indemnify us for your use of Risemee feature as outlined in the Terms of Use.

You acknowledge and agree that the use of the Service is at your own risk, and the Company provides no representation or warranty whatsoever regarding any Services.

REFUND POLICY

Generally, the fees you have paid from the Website for the Services are non-refundable and/or non-exchangeable, unless otherwise is stated in this Refund Policy or is required by applicable law.

You are required to send your refund request to our support team via e-mail [email protected].

Note for residents of certain US states. If you reside in California, or Connecticut and cancel the purchase at any time prior to midnight of the third business day after the date of such purchase, we will return the payment you have made.

Note for the EU residents. If you are an EU resident, you have the right to withdraw from service agreement without charge and without giving any reason within fourteen (14) days from the date of such agreement conclusion, unless you provided consent to an immediate agreement performance. YOU HEREBY EXPRESSLY CONSENT AND ACKNOWLEDGE THAT THE PERFORMANCE OF THE AGREEMENT BEGINS IMMEDIATELY AND THAT YOU WILL LOSE YOUR RIGHT OF WITHDRAWAL FROM THE AGREEMENT ONCE OUR SERVERS VALIDATE YOUR PURCHASE AND THE APPLICABLE PURCHASE IS SUCCESSFULLY DELIVERED TO YOU.

Therefore, if you cancel the purchase for any reason within 14 calendar days from the date of purchase, you will be entitled only to a proportionate refund.

Refunds will not be processed if more than 14 days have passed since the date of purchase. Additionally, refunds will not be granted if the user has misplaced or forgotten their login credentials, including their username and/or password. You understand ang agree that it is important to ensure the security and accessibility of login information to avoid any complications with refund requests.

No refund can be issued to a user in case the reasons for a refund are completely beyond our control. They include, but are not limited to:

  • You do not have Internet access;
  • A user does not accept technical assistance;
  • Personal reasons (I’ve changed my mind, I’ve made a purchase by mistake, Services were not used, etc.).
  • Financial reasons (you did not expect that you will be charged, that the trial will be converted into the subscription, that the subscription will automatically renew, or that the services are paid, etc.).

We do not accept refunds based on individual sensitivities or intolerances. If you believe that you for some reason deserve a refund, please email [email protected].

All requests for refunds must be made by the person who originally purchased the membership.

Apple App Store/Google Play Market Refund Policy

Purchases (made via an Apple App Store/Google Play Market) are subject to Apple App Store's/Google Play Market's refund policies. This means when a purchase for a Subscription is made through an Apple App Store/Google Play Market, we cannot grant refunds. You will have to contact an Apple App Store/Google Play Market support.

You acknowledge and agree that the availability of our Service is dependent on the third party from which you received the Service, e.g., the Apple App Store/Google Play Market.

You agree to pay all fees charged by the Apple App Store/Google Play Market and us in connection with the Service. You agree to comply with, and your license to use the Service is conditioned upon your compliance with, all applicable agreements, terms of use/service, and other policies of the Apple App Store/Google Play Market. You acknowledge that the Apple App Store/Google Play Market (and its subsidiaries) are a third party beneficiary of these terms and will have the right to enforce its terms.

You hereby represent and warrant (i) You are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) You are not listed on any U.S. Government list of prohibited or restricted parties.

Company’s use and transfer to any other app of information received from Google APIs will adhere to the Google API Services User Data Policy , including the Limited Use requirements.
